  1. Dr. Pabitra Kumar Karan, resident of Municipal Road, Dangapara, P.O.&P.S.-Kalna, Dist. Burdwan, and also attached as Medical Officer of Nabadwip S.G. Hospital
  2. Eve Land Nurshing Home, at Madhuban (Baidyapur More) P.O. & P.S.-Kalna, Dist. Burdwan, represented by its Proprietor.
  3. Fortis Hospital Limited, Situated at 730, Anandapur, EM Bypass Road, Kol-700107.

Today is fixed for furnishing death information of the complainant and further order.

O.P. No.1 files hazira through the Ld. Advocate as well O.P. No.3.

O.P. No.2 is absent without steps. Complainant did not take any step. On repeated calls, none appeared of the complainant.

Heard the Ld. Advocate for the O.P. Perused the case record. It appears that on 13.09.2022, the Ld. Advocate for the complainant informed that the complainant has already expired but the date of death has not been mentioned in the petition nor filed any death certificate. At time, the complainant did not take any steps and sometimes the Ld. Advocate for the complainant files petition for time.

The case is originated in the year 2016 but this day, the complainant is absent on call without intimation.

Under the above facts and circumstances, we are of the opinion that this case should be dismissed u/S 13(2) (c) of the C.P. Act, 1986.

Hence, it is

o r d e r e d

that this case being No.14/2016  be and the same is dismissed for default.

Let a copy of this order be given to the parties on free of cost.
