It is seen from the adjudication that the complainant is continuously absent for a long time and not come forward to take steps against the death of 2nd opposite party. It is further noticed that inspite of sufficient opportunities given to the complainant he has neither appeared nor to file the Proof Affidavit of the complainant in order to prove his complaint. The attitude of the complainant clearly reveals the fact of his disinterest in this matter. Moreover, it is pending from 2007 and therefore, there is no justification to prolong further without any progress.
Hence, this complaint is dismissed for default. No costs.
