JUSTICE SHRI.K.R.UDAYABHANU,PRESIDENT

 

          The petitioner is the complainant in CC.420/05 in the file of CDRF, Kozhikode.  The petitioner has sought for transfer of the case to some other Forum.   

          2. It is the allegation that during the trial of the case, the President of the Forum made some comments against the petitioner.  It is also alleged that the President openly supported the first opposite party.

          3. The counsel representing the respondents/opposite parties has  submitted that the evidence is already over before the Forum and that transferring the case at the present stage would not be in the interests of the Justice.

          4. The remarks of the President was called for.      The President has mentioned that he only suggested a settlement but the complainant demanded a huge amount and the matter could not be settled.

          5. We find that the petitioner has not disclosed the alleged disparaging remarks made by the President.  In the absence of the reproduction of the alleged disparaging remarks, we are not in a position to consider the request of the complainant in the proper perspective.   Hence, we find that the petition cannot be allowed and the same is dismissed.

          6. All the same, the Forum is directed to dispose of the matter on merits and not influenced or prejudiced on account of the application filed for transferring the case.

          The office will forward the copy of the order to the Forum urgently.
