JUSTICE SHRI.K.R.UDAYABHANU      :    PRESIDENT

 

         

The  appellants are the opposite parties in C.C. 66/07 in the file of CDRF, Palakkad.  The delay sought to be condoned is of 454 days. In the affidavit filed by the Asst. Manager (Legal) is submitted with the case file got displaced in the office of the appellant.  We find that the proposed appellant/HDFC Bank Ltd  is rather large institution having sufficient man power can not be expected to advance such argument.  Further no details as to any steps taken against the defaulting official have also been mentioned.  In the circumstances we find that the reason mentioned for condoning delay is not sufficient or adequate  to condone the delay of about 1 ½  years.  Hence the application to condone the delay is dismissed and consequently the appeal is also dismissed.
