Heard both parties. It is an admitted fact that there are 172 days delay in filing the complaint. The learned counsel though vehemently argued  failed to convince the Fora the genuine reason that prevented the complainant from filing the complaint in time. The settlement attempts and its failure to achieve success cannot be taken as ground for condonation of delay. So also power of Attorney holder was out of station for such a long period of 172 days cannot be considered as a reasonable cause for the purpose of condoning the delay. Hence we are of considered opinion that this complaint is not entertainable since it is not filed within the limitationperiod. As a result the above complaint stands dismissed.
