            Today is fixed for taking steps for service of fresh notice upon the Jdr.  The Dhr. files a petition intimating that the final order dated 16.8.2013 passed in D.F. Case No.29/2008 has been challenged by preferring an appeal being No.FA/82/2014 before the Hon’ble State Commission and said appeal is still pending.  In the petition the Dhr.has further stated that as the appeal is still pending the Dhr. is not in a position to take steps for service of fresh notice upon the Jdr.

            The contents of the petition clearly show that the matter is still sub-judice.     So, the execution case is premature.  Accordingly, it should be rejected.  Hence, it is

that the execution case being No.08/2014 is rejected.

Let the copies of this order be supplied to the parties free of cost.
