The complainants’ cases are as follows: The complainants had joined in the deposit scheme conducted by the respondents upon the assurances made by them.  On 21.3.07 the 1st complainant had joined in the scheme as per passbook No.1005 and paid Rs.6780/- in the 300 daily kuri of the respondents whereas on 1.12.07 the 2nd complainant had joined in the same scheme as per passbook No.2298 and paid Rs.1000/- to the deposit scheme. Upon maturity the complainants demanded the amount as per the terms of the deposit scheme. But not returned so far. The respondent firm remain closed due to the inefficient working of the respondents. The non-return of the deposited amount shows deficiency in service and unfair trade practice on the part of the respondents. The respondents are now conducting in the name of Dr. Ambedkar Samajam Charitable trust having head office at Chalakudy and Unit Offices at Mala, Kodakara, Thalore, Irinjalakuda and the 2nd respondent is the Managing Trustee of both the firms. The complainants had approached the respondents repeatedly for the return of the deposited amount with interest. But not returned so far. Hence the complaint.

          3. To prove the case of the complainants both filed affidavit and produced Exts. P1 to P3 documents.

          4. According to the complainants they have made deposit in the 300 daily kuri conducted by the respondents. The 1st complainant paid Rs.6780/- as per Ext. P1 passbook and 2nd complainant had paid Rs.1000/- as per Ext. P2 passbook towards the said deposit scheme. But the respondent firm remain closed due to the misappropriation of money and mismanagement by the respondents whereas they have started head office and unit offices in another places. The respondents did not return the deposited amount even after maturity.

          5. There is no evidence to the contrary.

          6. In the result the complaint is allowed and the respondents are directed to return the complainants’ kuri amount as per Ext. P1 and P2 passbook with 12% interest from the date of filing the complaint till realization together with costs Rs.500/- (Rupees five hundred only) each to the complainants within one month from the date of receipt of copy of this order.
