               The complaint has been filed by the complainant U/S 12 of Consumer Protection Act 1986 alleging medical negligence in treating his wife resulting in death of the patient and with the direction to pay a sum of Rs.10,00,000/- towards compensation for her death.
It is found that this case has been filed in Chengalpattu in 2004 and has been transferred to this Commission in 2014 and renumbered as CC.No.70/2014.  It is reported by the complainant’s son that the complainant is dead and he has to be impleaded as the legal heir.  Though petition was filed and allowed the complainant’s counsel or the complainant did not take any steps to amend the complaint in accordance with the CMP.  As sufficient opportunities were given and the complainant side never turned up we are of the view that there is no purpose in keeping the complaint on file.  Hence, this consumer complaint is dismissed for default.  No cost.
 
This order has pronounced by us in the open Commission on this 31th May 2022.
