This appeal coming before us for final hearing on 10.2.2015 and on hearing the arguments of both sides, and upon perusing the material records, this commission made the following order.

                        

THIRU.J.JAYARAM, JUDICIAL MEMBER

1. This appeal is filed by the complainant against the order of the District Forum, Erode in CC 12/2008 dated 22.7.2010 claiming enhanced compensation.

2. The appellant/complainant filed CC 12/2008 claiming compensation from the opposite parties for their negligence and deficiency in service in treating the complainant in their hospital.

3. The complainant has claimed compensation of Rs.10 lakhs as follows:-

          Medical expenses Rs.2,85,000/- compensation for pain and suffering Rs.50,000/-, loss of income Rs.1,10,000/-, compensation for disability and loss of income from 20.7.2007 18 years Rs.8,60,000/- and totally Rs.13,05,000/-but the complainant has restricted his claim to Rs.10 lakhs.

4. The District Forum allowed the complaint in part awarding total compensation of Rs.3 lakhs to the complainant with costs of Rs. 3000/-.

5.  Having regard to the facts and circumstances of the case and considering the grounds of appeal, we feel that the award of compensation of Rs. 3 lakh (in total) is quite reasonable and the order of the District Forum, Erode does not warrant interference of the commission.

In the result, the appeal is dismissed, confirming the order of the District Forum.

No order as to costs in the appeal.
