Appellant through Mr. A. Mukherjee, the Ld. Advocate and Respondent No. 3 through Mr. Sujoy Kr. Basu, the Ld. Advocate is present.  Respondent No. 2 is absent on calls.  The Appellant submits that the order of the Ld. Forum below dated 10.03.2008 was passed without taking any evidence from either side.  The matter was also not heard on merit.  The order is, therefore, considered superficial and not in accordance with law.  He prays for remanding the case to the Forum below for proper adjudication after both sides are allowed to file evidence and the matter is heard on merit.  The Ld. Advocates for the Respondent Nos. 1 & 3 also agree with the contention of the Appellant.  It is accordingly ordered that the case be sent to the Forum below on remand for hearing afresh after directing both sides to adduce evidence and also for cross-examination of the evidence as might be adduced by the respective sides.  The matter should be heard on merit and the dispute be decided as per law within a period of 90 days from the date of receipt of the order.  The appeal be allowed on contest without cost.  The order of the Ld. Forum below is set aside.
