Both parties file hazira through Advocate.

The case is fixed for argument. After hearing arguments from both sides the Commission proceeds to dispose of the case as hereunder: -

The Complainant’s case is that the O.P. Doctor is a House Physician of the Complainant’s family and his wife Smt. Bandana Kar is under his continuous treatment and supervision for her restless behavior and depression. In course of such treatment the O.P. Doctor is alleged to have pushed medicines to the patient at higher rate than the market price sometimes under prescription without any mention of his Registration Number. Lastly on 12/07/2018 the O.P. allegedly advised medicines compelling again to procure the same from him but refused to give any Cash Memo for the same. With this allegation the instant complaint has been filed against the O.P.

The O.P. contested the case by filing a written version denying all the material allegations,  made in the complaint but contending inter alia that it is neither a case of medical negligence nor deficiency in service and unfair trade practice as alleged by the Complainant and prayed for dismissal of the case.

            -: Decision with reasons: -

Having regard to the facts of the case, contention and submission and documents on both sides the Commission finds from the record that the O.P. Doctor prescribed medicines to the Complainant’s wife from time to time bearing Registration Number-34384 of WBMC and so the O.P. Doctor cannot be said to be an unregistered Medical Practitioner. There is no proof on record as to sale of any unauthorized medicines by the O.P. to the Complainant. The Complainant is equally responsible for purchase of unauthorized medicines from the O.P. Doctor if the fact is so true.

Upon consideration of the facts and circumstances of the case and materials on record the Commission thinks that the instant complaint is totally misconceived and the Complainant is not entitled to get any relief in this case.

Hence it is ordered……..

That the case be and the same is dismissed on contest.

Both parties be supplied copy of this order free of cost.
