Order date: 20 .11.2024.

Today is fixed for passing order in respect  of M.A. case being No. 80/2024. 

             Ld. Advocate for the complainant is present.

            The OP is absent.

On 13.08.2024  the complainant  has filed a petition, supported by an affidavit, stating that complainant No.1 was treated by the OP No.1 on 28.12.2018. After examination of the patient, the OP No.1 prescribed some pathological tests and thereafter, he performed surgery of the complainant No.1 on 07.01.2019 at Skylark Nursing Home.  Due to gross negligence of the treatment rendered by the OP No.1, the condition of the patient became bad to worse.

 In this  situation, the complainant No.2 prays  for passing  necessary order by appointing a  Medical Board  with the doctors of the Gynecological Department from the AIIMS, , Delhi/ Kalyani  for expert opinion,  for proper adjudication of the case and to protect the natural justice,  as  because there is some medical negligence on the part of the OPs. 

Heard the Ld. Advocate for the complainant.

Having considered the submission of Ld. advocate for the complainants , perused  the complaint, M.A. case and other documents  relating to  treatment of the complainant No.1 rendered by the OP No.1  

,  we are of opinion, that  the prayer of the complainant should be allowed.  

Hence, it is

                                                  ORDERED

that the M.A. case being No. 80/2024 be and the same is  allowed without any cost.

Considering the vicinity of the AIIMS, Kalyani, Nadia, the Medical Superintendent of AIIMS, Kalyani, Nadia is directed to form a Medical Board consisting with doctors, Department of Gynecology for giving an expert opinion.

The complainant is directed to submit all the required documents i.e the complaint, M.A. case, W/V and treatment sheet  along with requisites for sending the same to the A.I.I.M.S., Kalyani, Nadia.

M.A. case being No. 80/2024 is thus disposed of.

Let a copy of this order be given to the parties on free of cost.

To  12.12.2024   for submission of  all the required documents i.e the complaint, copy of M.A. case, W/V and treatment sheet  along with requisites for sending the same to the A.I.I.M.S., Kalyani, Nadia.
