ORDER

Present:-  Shri Aprajit, Advocate for  complainant with Complainant.  

Heard. Apparently there is no document on record which is getting corroboration from the prescription slips filed in the court w.r.t. facts as stated in the complainant, particularly, no description with respect to the disease Glucoma, is not on record. Further the alleged deficiency came to the knowledge of complainant admittedly in 2019 and complaint is being filed in 2023 i.e. 25.04.2023. The delay has also not been explained. Apart from that the complainant resides in North-East and OP are stated to be having their office in Darya Gunj, New Delhi. Therefore, the issue w.r.t. the jurisdiction of this Commission is also there.

At this stage complainant submits that the present complainant be returned to him with liberty to file the same before court of appropriate jurisdiction. This request of complainant is allowed,  but in these circumstances subject to cost of Rs.1000/- upon the complainant to be deposited in State Commission Welfare Fund (Legal Aid) Account No.10310544717, State Bank of India, I.P. Estate, New Delhi. Complaint is returned to the complainant alongwith all original documents after retaining photocopy.
