Learned counsel Sh. Arun Himani for the appellant as well as learned counsel Sh. Sudhanshu Dwivedi for respondent No. 1 has appeared. None has appeared on behalf of the respondent Nos. 2 & 3 inspite of several calls.

Learned counsel for the appellant has moved an application stating that L.R. of deceased named Rakesh Bedi has repaid the entire amount due to the appellant and original documents mortgaged with the society have also been returned to the said L.R. Rahul Bedi – son of the deceased, which has been duly received by him on 27.06.2022, hence, the concerned correspondence is attached herewith for perusal of the Commission.

The above-mentioned document alongwith photocopy is of said payment receipts is kept on record, which has showed that the entire amount due to the appellant has already been repaid and the legal heir Sh. Rahul Bedi of the deceased Rakesh Bedi has received the original papers, i.e. sale deed.

Learned counsel Sh. Arun Himani for the appellant has stated that his client does not want to press the appeal and put today a noting in the side of the order sheet in this regard.

In the above mentioned circumstance, the appeal has become infructuous, hence, the appeal shall stand as dismissed with no order as to costs.

                       File be consigned to the record room alongwith copy of this order. Original file be sent back to the Commission concerned.
