        The learned counsel for the complainant and opp.parties  are present.   The complainant filed a petition to permit him  to withdraw the  complaint with a liberty to file a  fresh case before the Civil Court or any other appropriate Forum  on the ground that the relief sought against the parties cannot be split up, one in Civil Court and another in District Forum.  Since the complainant  intends  to get the case withdrawn we do not see any  impediment  to grant leave to file a fresh case  before appropriate  Court or Forum.

In the result  this  C.C. is dismissed with the above said observations. No costs.
