Today is fixed for hearing of the M.A case and objection, if any.           

             Ld. Advocate for the complainant is present.

            Ld. Advocate for the OP Nos. 1&2 is present.

No objection has been filed by the OP Nos. 1&2.

Heard both sides in full.

On 29.09.2024  the complainant has filed a petition, supported by an affidavit, stating that the father of the complainant  was admitted before  the OP No. 2, Hospital under OP No. 1 with several complication and ailments. At the time of admission before the OP No. 2 Hospital there was light bed sore at the hip of the father of the complainant. But due to carelessness and negligence on the part of the both OPs the condition of bed sore became worse condition and the father of the complainant till his last breadth compelled to bear the extreme pain for that.  The complainant has filed this instant case for the deficiency in service and medical negligence on the part of the OPs. More over the OPs applied high end drugs “Meropenem” to the father of the complainant at the higher rate.  So, for ascertaining whether there was any medical negligence or not and for proper adjudication of the case opinion of Expert Doctor  from Nil Ratan Sircar Medical College & Hospital is required as well as necessary. 

In this situation,  the complainant prays for passing necessary order directing the MSVP of Nil Ratan Sircar Medical College & Hospital to appoint any Expert Doctor from the FIELD of MANAGEMENT AND TREATMENT OF BED

SORE  for giving their opinion in writing after perusing the documents of the treatment.

Heard, the Ld. Advocate for the complainant.

Having considered the submission of Ld. advocate for the complainant , perused  the complaint, M.A. case and other documents  relating to  treatment sheet,  we are of opinion, that  the prayer of the complainant should be allowed.  

Hence, it is

                                                  ORDERED

that the M.A. case being No. 77/2024 be and the same is  allowed without any cost.

The complainant is directed to submit all the required documents i.e the complaint, M.A. case, W/V and treatment sheet  along with requisites for sending the same to the Nil Ratan Sircar Medical College & Hospital M.A. case being No. 77/2024 is thus disposed of.

Let a copy of this order be given to the parties on free of cost.

To  15.01.2025   for submission of  all the required documents i.e the complaint, copy of M.A. case, W/V and treatment sheet  along with requisites for sending the same to the Nil Ratan Sircar Medical College & Hospitals.
