1.      This complaint was filed on 21.09.2016 wherein complainant alleged
that he was operated by OP  at Ayurvedic and Unani Tibiya College
Hospital, Karol Bagh in April 2012 for treatment of piles but he could
not get any relief.  It was further stated that there was infection
where he was operated. He is feeling weakness and  his weight is
reduced so help is prayed.
2.      Heard on the maintainability of the complaint.
3.      Mere perusal of the complaint clarify that complainant was operated
in the hospital where no charges whatsoever were charged from the
complainant. It is no where mentioned in the complaint that
complainant has paid any charges to the OP. Hon’ble Supreme Court in
the case Indian Medical Association V/s V.P. Shanthan , AIR 1996 SC
550 held that “services rendered at a non-government hospital where no
charges whatsoever is made from any person availing the service and
patients are given free service is outside the purview of the
expression service as defined in Section 2 (1) (o) of this Act”.
4.      In these above facts and circumstances , we are of the opinion that
this complaint is not maintainable under the provision of Consumer
Protection Act 1986 hence dismissed. File be consigned to record room.
