Today is the date fixed for order on the point of admission of this complainant filed by Dipak Kumar Dutta against Dr. P.K. Choudhury , R/o M/13, Bariatu Housing Colony , Ranchi on the allegation of wrong treatment of the complainant by the Op for aperiod of 9 years from 1996 to 2005 claiming Rs. 5(five ) Lacs as compensation and expenses incurred by the complainant .

                       If  is mentioned in para-3 that since 1996 to 2005 the complainant was under the treatment of the Op at Ranchi . It is further case of the complainant that he has got some P.N.S. proble and he has been under treatment of the O.P Doctor for a long period but he did not get any relief and as such the complainant began to take treatment for Dr. S. Rath of Orisa and got some relief . 

                       When the complainant asked regarding the jurisdiction of this Forum the learned lawyer for the complainant referred to para-11of the complainant petition in which it is mentionede that the complainant sought for appointment on telephone from Jamshedpur and the O.P. also works and visit to the complainant for again at Jamshedpur . This plea appears to have taken only to create the jurisdiction petition in which it is  specifcally mentioned the treatment was at Ranchi .

                       The members have considered the contention of the complainant and they also perused the complainant petition and they are of the opinion that this Forum has got no jurisdiction to entertain this complainant . it is only District Consumer Forum , Ranchi which has got jurisdiction. Thus this complainant is fit to be  rejected and it is accordingly rejected under Sec. 12(3) of the Consumer Protection Act in absence of territorial jurisdiction of this Forum .
