This complaint having come up for final hearing before us on 09.10.2014, on perusal of the material records and on hearing the arguments of Thiru.Vedai Ramachandran, Counsel for the complainant, Thiru.S.Raman counsel for the 1st opposite party, Thiru.R.Balaji, counsel for the 2nd opposite party and having stood for consideration, till this day the Forum passed the following
ORDER.

This complaint is filed by the complainant u/s 12 of the Consumer Protection Act 1986.
2. The gist of the complaint filed by the complainant is that the complainant had undergone Vaginal Hysterectomy surgery done by the 1st opposite party with the assistance Dr.Thiagarajan, D.A. and staff nurse Mangai. Due to the improper method adopted by the 1st opposite party, the complainant developed intermittent Hemastasis and also distension of upper abdomen from the date of operation and it was treated by the 1st opposite party without disclosing the same to the complainant’s relatives. The 1st opposite party subsequently suggested that the complainant was in a condition to consult the Urologist for better treatment and advised the complainant to get the opinion from the Dr.U.Sivakumar,M.S.M.Ch., (Urology) and Dr.M.Chandrasekarn,M.S(Surgeon) on 13.11.2005. As advised by the Urologist Dr.U.Sivakumar the 2nd opposite party, the complainant was shifted to Thanjavur and admitted in Rohini Hospital on 14.11.2005 and she was treated there as inpatient till 04.01.2006. The complainant was affected by the post operational infection due to negligence on the part of the 1st opposite party. Even though she noticed symptoms of that complications at earlier stage itself, she had not given proper treatment at the earlier stage itself, she had not even bothered to get opinion from the specialist. Because of the deficiency of service of the 1st opposite party the complainant went to unconscious state and had to be shifted to Thanjavur for better medical aid. The 1st opposite party had charged and collected Rs.40,000/- for the said treatment and operation. The complainant has suffered a lot both physically and mentally till today and under gone several treatments under the specialist in urology at Thanjavur and incurred expenses to the tune of Rs.3,00,000/- . The complainant’s entire physical activities were paralyzed. The 2nd opposite party after careful diagnosis and observation gave treatment to the complainant as inpatient from 14.11.2005 to 04.01.2006. The complainant had also undergone another surgery at Thanjavur as proposed by the 2nd opposite party and the complainant’s condition somewhat improved after that. The complainant’s physical condition became worse due to series of operations undergone by her. Due to the deficiency of service of the 1st opposite party she underwent an operation for fixing mesh in abdomen on 30.04.2007 in Dr.Ansari Hospital at Nagapattinam. Dr.M.Chandrasekaran, M.S. had performed that operation and the complainant was discharged only on 04.05.2007. Even after that operation the complainant’s physical position has not been stable and she is not able to look after her day to day domestic work by herself and has to depend on somebody to carry out even her normal routine. The post operational treatment and diagnosis by the 1st opposite party was also wrong which led to the complainant’s present critical position of being unable to manage herself even to carry out her daily routine without somebody’s assistance. The 1st opposite party had also not given the case sheets for the treatment given for the period from 05.11.2005 to 14.11.2005 to the complainant which itself would prove the total negligence and deficiency in service standard by the 1st opposite party. The complainant had thus totally spent nearly Rs.6,00,000/- apart from the loss in her husband’s business due to the reckless treatment undergone by her at the hands of the opposite parties. The 2nd opposite party having given better treatment to the complainant after 14.11.2005, given opinion against complainant’s physical order. He has been arrayed as formal party to this complaint and no claim is made against him in this complaint. The complainant therefore prays for an order to direct the 1st opposite party to pay the sum of Rs.10,00,000/-(Rupees Ten lakhs only) towards compensation to the complainant for her physical permanent disability, mental agony and hardship caused due to her deficiency of service, to pay the sum of Rs.5,000/- towards cost of this litigation and other expenses and to grant such and other reliefs as this Forum may deem fit.
3.The gist of the written version filed by the 1st opposite party is that the averments found in the complaint are all false and he has not made out any prima facie case of negligence as against the 1st opposite party and the complaint is liable to be dismissed in limine, as a vexatious one. As per the decision of the Hon’ble Supreme Court the complainant has to submit herself before the panel of eminent Doctors to find out the medical negligence as alleged by her and on the basis of the report only any complaint should be taken on file by this Hon’ble Forum. The 1st opposite party reserves her right to file any additional counter after going through the report of the panel of Doctors to be filed before this Forum. The amount of compensation so claimed unilaterally is highly excessive and beyond the proposals of law and fact. The complaint is also barred by the limitation and the detailed reply given by the 1st opposite party to the lawyer’s notice sent by the complainant may also be read and part and parcel of the written version. Therefore the complaint may be dismissed with exemplary cost to the 1st opposite party.
4. The gist of the written version filed by the 2nd opposite party is that the 2nd opposite party is unnecessarily added as a party to the complaint and he is totally an unnecessary party. The complaint is therefore liable to be dismissed for misjoinder of party. If at all the complainant would like to prove any fact through this 2nd opposite party, the latter could only be examined as a witness by the complainant and he ought not to have been added as a party. The complaint is therefore liable to be dismissed with cost of this 2nd opposite party.
5. The complainant filed her proof affidavit reiterating all the averments made in the complaint and has filed 116 documents in proof of her claim and they all are marked as Exhibits A1 to A116. The 1st opposite party has filed her proof affidavit in support of her defence. She has not filed any documents and both the complainant and the 1st opposite party have filed her written arguments. The 2nd opposite party has filed a memo stating that he has been added only as a formal party and as no relief is claimed as against him by the complainant, he has no arguments to be addressed except for the dismissal of the complaint with cost as against him.
6.Points for the consideration:-
1. Whether the complaint is barred by the period of limitation?
2. Whether there is deficiency of service on the part of the 1st opposite party?
3. Whether the complainant is entitled to any relief? If so to what?
7. Point 1: The main allegation of the complainant is that the 1st opposite party did the Vaginal Hysterectomy surgery without any assistance of the qualified Surgeon adopting improper method which has caused the development of Intermittent Hemastasis and also distension of upper abdomen because of the negligence and deficiency of service of the 1st opposite party. The complainant had to undergo untold sufferings, inconvenience and hardship in taking further treatment with Dr.U.Sivakumar(Urology) at Rohini Hospital, Thanjavur and then with Dr.M.Chandrasekaran, M.S. at Dr.Ansari Hospital, incurring heavy expenditure of not less than Rs.6,00,000/- in that regard. Further she has lost stability of her physical position being not able to look after her day to day domestic work herself and has to depend on somebody to carry out even her normal routine. Exhibit A3 is the discharge summary issued by the 1st opposite party along with the discharge summary relating to the treatment given by the Dr.U.Sivakumar (Urologist) at Rohini Hospital, Thanjavur. The discharge summary issued by the 1st opposite party reveals that the complainant was admitted in her Nursing Home on 05.11.2005, Hysterectomy surgery was done on the same day at 6P.M. and was discharged on 13.11.2005.
8. The operation notes of the opposite no.1 reveal that there was Intermittent Hemastasis noticed, but the POP was uneventful. The patient developed Hematoma and distension of upper abdomen and the 1st opposite party had sought an opinion of Urologist Dr.U.Sivakumar and the Surgeon Dr.M.Chandrasekaran and for the treatment to be given by the Urologist the complainant was discharged on 13.11.2005 from the Rohini Hospital, Thanjavur. The discharge summary of Dr.Sivakumar, the Urologist has revealed that the complainant was admitted on 14.11.2005 at 2.35P.M at the Rohini Hospital, Thanjavur surgery was done on 15.11.2005 by the Urologist and was discharged on 04.01.2006, as evidenced by Exhibit A3 itself. Exhibit A104 has revealed that the complainant had treatment with the Urologist Dr.U.Sivakumar for her abdominal pain even in June 2005 itself, as she was admitted in the Rohini Hospital on 27.06.2005 the surgery having been done on 27.06.2005 and she was discharged on 29.06.2005. The 1st opposite party has referred the complainant to Dr.U.Sivakumar, the Urologist for distension of her upper abdomen and he treated the complainant as inpatient at the Rohini Hospital and discharged on 4.1.2006.

The contention of the complainant is that her physical condition became worse due to the operation of the 1st opposite party and she had undergone an operation for fixing mesh in upper abdomen on 30.04.2007 in Dr.Ansary Hospital at Nagapattinam. Dr.M.Chandrasekaran, M.S. having performed the surgery before discharging her on 04.05.2007, as would be evidenced by Exhibit A104. The complainant was having some abdominal pain and complications even prior to the Hysterectomy and she had taken treatment on 30.04.2007 by fixing mesh in her abdomen through Dr.M.Chandrasekaran, M.S.

The complainant had been a diabetic trough out right from the beginning and as would be evidenced by Exhibit A5 to A10, Exhibit A17 to A22 and Exhibit A105 and106, she was not at all having constant level of blood sugar. The surgery done by the Urologist Dr.U.Sivakumar is in furtherance of the developments consequent to the Vaginal Hysterectomy done by the 1st opposite party and the patient was discharged on 04.01.2006 from the Rohini Hospital, Thanjavur. After the treatment by the said Urologist Dr.U.Sivakumar subsequently the complainant had taken treatment for fixing mesh in abdomen by Dr.M.Chandrasekaran, M.S. in Dr.Ansari Hospital, Nagapattinam on 30.04.2007 and was discharged at 04.05.2007. The contention of the 1st opposite party is that the complaint is hopelessly by the period of limitation in as much as it is not filed within 2 years from 14.11.2005, when the complainant was admitted in Rohini Hospital, Thanjavur as inpatient for treatment by the Urologist.

The another contention put forth by the 1st opposite party is that there is no nexus between the Hysterectomy done by her on 05.11.2005 and the treatment given by the Dr.M.Chandrasekaran, M.S. to the complainant on 30.04.2007 in Dr.Ansari Hospital, Nagapattinam. The Exhibit A114 has disclosed that the complainant had also taken treatment as inpatient in Selvarangam Hospital, during the period from 18.07.2011, when she was admitted as inpatient till 21.07.2011, when she was discharged by Dr. A.B.Selvarangan. The said treatment is also given for her abdominal pain. No discharge summary given by Dr.M.Chandrasekaran for the treatment given to the complainant during the period from 30.04.2007 to 04.05.2007 is filed by the complainant. Nor an affidavit of the said Dr.M.Chandrasekaran, M.S is also filed in that regard. It is not proved by the complainant that the said treatment taken by her with Dr.M.Chandrasekaran, M.S is in furtherance and continuation of the complications arose out of the Hysterectomy surgery done by the 1st opposite party. Only the treatment given by the Dr.U.Sivakumar, Urologist is in furtherance of the Hysterectomy surgery done by the 1st opposite party and the complainant was discharged on 04.01.2006 after the treatment in normal condition.

In such circumstances the complainant ought to have filed the complaint at least on or before 04.01.2008 before the expiry of 2 years from 04.01.2006, the date of discharge of the complainant from the Rohini Hospital, Thanjavur by Dr.U.Sivakumar, Urologist. But the complaint is filed on 30.07.2008. No explanation is given in the complaint as to how the complaint can be treated to have been filed within the period of limitation. Nor the complainant has invoked the provisions contained under Sec.24A (2) of the Consumer Protection Act 1986, for admitting the complaint. In such circumstances this Forum finds that the complaint is not filed within the period of limitation from the date of cause of action and hence it is dismissed as barred by the period of limitation as per Sec.24A(1) of the Consumer Protection Act 1986.
13. Point 2 & 3: In view of the decision of the State Consumer Disputes Redressal Commission, Goa reported in 2013 (3) CPR 54,

In which it is held that “as a matter of law the Consumer Forum must deal with the complaint on merits only if the complaint has been filed within 2 years from the date of accrual cause of action and if beyond the said period the sufficient cause has been shown and delay condoned for the reasons recorded in writing. If the complaint is barred by the time and yet the Forum decides the complaint, the Forum would be committing an illegality and therefore the aggrieved party would be entitled to have such order set aside”
14. Therefore as the complaint is barred by the limitation, this Forum is not inclined to give its finding on the point no.2. Therefore the complaint is dismissed.
15. In the result, the complaint is dismissed; there is no order as to costs
