Case is called out.

Smt. Shashi Yogeshwar, learned counsel for the appellants is present.

Sh. A.S. Shah, Advocate has filed Vakalatnama on behalf of respondent No. 1.

Vide order dated 21.02.2023, the appellants were permitted to delete the names of respondent Nos. 2 and 4 from the array of parties to the appeal.

None is present on behalf of respondent No. 3, although service of notice upon respondent No. 3 has been held to be sufficient vide order dated 21.02.2023.

A Compromise Deed has been filed on behalf of the appellants and respondent No. 1, stating therein that the compromise has taken place between them, hence the appeal should be decided in terms of compromise. 

The Compromise Deed has been verified by learned counsel for the appellants and respondent No. 1.

Learned counsel for the appellants and respondent No. 1 state that this appeal may be decided in terms of the compromise.

Accordingly, the appeal is decided in terms of the compromise, which shall form part of the order.

The amount deposited by the appellants with this Commission, be released in their favour.
