On 18.06.2024 the complainant has filed a petition supported by an affidavit, stating that this is the case of medical negligence, so for proper adjudication of this case, the opinion of medical expert in the field of Psychiatry is very much essential as per provisions of law and prays for passing an order directing the M.S.V.P of Calcutta Medical College & Hospital to transmit the matter to the department of Psychiatry for opinion of expert.
Ld. Advocate for the OP No.1 files no W/O but at the time of hearing verbally raised mild objection.
Ld. Advocate for the OP Nos. 2 & 3 , with his usual fairness, states that they have no objection.
As such, we are of opinion, the prayer of the complainant should be allowed.
Hence, it is
ORDERED
that the M.A. case being No. 57/2024 be and the same is allowed without any cost.
The Medical Superintendent-cum-Vice Principal, Calcutta Medical College & Hospital, 88, College Street, Chittaranjan Avenue, Kolkata-700073 , is directed to a form a medical board consisting with the doctors of the Department of Psychiatry for giving an expert opinion.
The complainant is directed to submit all the required documents along with requisites for sending the same.
Let a copy of this order be given to the parties on free of cost.
M.A. case being No. 57/2024 is thus disposed of.
