Order No.  9  dated  11/09/2014

Record is put up for order in respect of the petition dt.27.3.14 filed by o.p. no.2 challenging the maintainability of the case. We have gone through the petition and materials on record. Upon considering the entire materials on record and submissions of both sides, we have observed that o.p. no.2 has provided the accommodation for holding an entrance examination which cannot be stand liable for the dispute in between the complainant and o.p. no.1. The dispute is in between the complainant and o.p. no.1 and complainant has prayed for relief against o.p. no.1 only. So, complainant has made the party o.p. no.2 only to create territorial jurisdiction under this Forum.

            Hence, ordered,

            That the case is rejected on contest due to want of territorial jurisdiction.

            Complainant is at liberty to agitate the issue on the self same cause of action before the appropriate Forum.

            Supply copy of this order to the parties free of cost.
