Today is fixed for hearing of the M.A. case being No. 46/2023.
Ld. Advocate for the complainant is present. Ld. Advocate for the OP Nos. 1 & 2 is also present.
Heard the Ld. Advocates of both sides.
On 31.03.2023 the complainant has filed a petition supported by an affidavit, praying for the opinion of Expert Doctor/Doctors of the Department of Ophthalmology which is very much required for proper adjudication of the instant case as well as for ascertaining the medical negligence on the part of the OPs and prays for passing an order directing the M.S.V.P , Burdwan Medical College & Hospital for appointing Expert Doctor/Doctors from the Department of Ophthalmology for giving his/their valuable opinion in this regard.
Ld. Advocate for the OPs files no W/O but at the time of hearing verbally raised objection.
As such we are of opinion, the prayer of the complainant should be allowed.
Hence, it is
ORDERED
that the M.A. case being No. 46/2023 be and the same is allowed without any cost.
The Medical Superintendent-cum-Vice Principal, Burdwan Medical College & Hospital, Burdwan, P.O. Rajbati, Purba Bardhaman , is directed to a form a medical board consisting with doctors of the Department of Ophthalmology for giving an expert opinion.
The complainant is directed to submit all the required documents along with requisites for sending the same to the M.S.V.P, Burdwan Medical College & Hospital, Burdwan, P.O. Rajbati, Purba Bardhaman in the meantime.
Let a copy of this order be given to the parties on free of cost.
M.A. case being No. 46/2023 is thus disposed of.
To 31.07.2024 for submission of report from the M.S.V.P, Burdwan Medical College & Hospital, Burdwan, Purba Bardham .
