This appeal has been filed against the order of the learned District Forum, Dholpur dated 21.6.2016 whereby the claim has been dismissed.

The contention of the appellant is that the sonography report given by respondent says that the skull of the child is big and having fluid whereas in second report the fetus was found normal. Hence,the claim should have been allowed.

 

Heard the counsel for the appellant and perused the impugned judgment as well as original record of the case.

 

The contention of the appellant is that as per sonography it was reported that skull of the fetus is big and having fluid but in the sonography report there is no such conclusion. Further it has been pleaded that Dr. B.D.Jindal has stated that the skull is big having fluid but no diagnosis of Dr. B.D.Jindal is placed on record. In the impugned sonography report there is specific finding that no gross foetal anomalies are seen and Medical Board has also of the opinion that in report a mild hydrocephalus was found and for which colour doppler study was advised and there was no negligence of Dr. Himanshu Bansal. Hence, in view of the categorical opinion of the Medical Board the Forum below has rightly held that the respondent has not committed any deficiency in service and claim has rightly been dismissed.

In view of the above, there is no merit in this appeal not worth admission and liable to be dismissed.
