This order is arising out of the M.A. being no-26/2018 filed by the Complainants praying for an expert opinion from an expert doctor relating in the field of Urology.
It is stated in the application that the Complainants have filed the Consumer Complaint being no-555/2014 alleging medical negligence against the OPs. So for proper adjudication of this complaint and for coming to a conclusive conclusion appointment of an expert Doctor is necessary in the field of Urology who will submit an expert opinion upon considering the treatment related papers of the concerned patient. According to the Complainants if this application is not allowed, they will suffer irreparable loss and injury and prayer are made by the Complainants for allowing this application.
The copy of this application have duly been received by the OP-1 and 3, who raised vehement objection against this application stating that at this stage this application should not be allowed as submission of the expert opinion from an expert will take much time for disposal of this complaint. The OPs have prayed for dismissal of the application.
Upon careful perusal of the application we have noticed that admittedly this complaint is filed by the Complainant against the OPs alleging medical negligence. It is true that for proper adjudication of this allegation and redressal of the grievance of the Complainants an expert opinion is required from an expert doctor in the said field, for which the patient was treated. The Complainants have sought for an expert opinion from the Head of the Department of Urology, Calcutta Medical College. In our view the prayer of the Complainants should be allowed as until and unless the opinion is forthcoming the complaint cannot be properly adjudicated upon.
Hence it is ordered that the MA being no-26/2018 is hereby allowed on contest without any cost.
Let plain copy of this order be given to the parties free of cost as per CPR, 2005.
