Today Col. G.K. Bauntiyal on behalf of the appellant – Proprietor Smt. Asha Bauntiyal has appeared.
A perusal of the order sheet dated 02.02.2023 has revealed that a compromise has already been filed on behalf of both the parties, but as per the terms and conditions of the compromise, a draft of Rs. 1,15,000/- (Rupees One Lakh Fiftheen Thousand only) was not deposited, hence, another date was fixed.
A draft No. 728584 for a sum of Rs. 1,15,000/- (Rupees One Lakh Fiftheen Thousand only) dated 06.02.2023 of Punjab National Bank has already been deposited on behalf of the appellant, which is kept on record.
As the terms and conditions have been fulfilled by the appellant in compliance of the compromise, therefore, the respondent is entitled to get the said draft from the record.
The above compromise is accepted and admitted by this Commission.
In terms of compromise (paper No. 71) the appeal is decided accordingly. The compromise shall form part of the decree. No order as to costs.
Statutory amount, if any, deposited by the appellant be returned to the appellant as per rules and law.
File be consigned to the record room alongwith copy of this order.
A copy of this order alongwith compromise be sent to the District Commission concerned for perusal and necessary information.
