Final Order / Judgement

Today is fixed for admission hearing. Ld. Advocate for the complainant files hazira.

The record is taken up for admission hearing. Ld. Advocate for the complainant files a firisti containing Xerox copies of document including various reports of diagnostic centre.

Perused the complaint. On going through the complaint and the documents so filed by complainant we find no prima facie case against O.P.Nos. 2,3 and 4at all. The complainant in her complaint stated that on 11.06.2018 after admission in the Raiganj District Hospital a scissor has been done by O.P.No.1 and one day after discharge from the hospital, but discharge certificate of the hospital shows that she was discharged on 15.06.2018 and was advised to come to hospital on 21.06.2018 to cut the stitch. But she came to hospital on 22.06.2018. This fact proves that the fact of discharge that one day after admission is not correct and she did not follow the advice of the doctor and the C.T. Scan report dt. 30.06.2018 disclosed that no such complication as stated by her in her complaint. Even, subsequently during treatment in the Raiganj District Hospital she was referred to Malda Medical College and Hospital for better management, but she did not follow the said advice also and went to Fatima Hospital at Purnea , Bihar  and the report dt.04.07.2018 of  C.T. Urography investigation of Ishan Diagnostic Imaging Centre, Purnea disclose the impression that  ‘the features are suggestive of left distal ureteric injury with uretero-uterine fistula with drainage of urine into the vagina’ and there is no such report or prescription or medical certificate to show that the said disease was caused by the O.P.No.1. Even, the complainant did not file any receipt in support of his claim to the effect that complainant expended Rs.5,00,000/- for medical treatment.

Under the above facts and circumstances we are opinion that there is no such material to attract the ingredients of medical negligence against all the O.Ps and as such the case is not admitted and disposed of.
