The record is put up today i.e on 25/10/2017 by both the parties.

Complainant / Dhr. files a petition stating to dismiss this Execution Application on the basis of the order dated 21-09-2017 passed by Hon’ble State Commission, West Bengal.

In support of his application the Complainant filed a copy of order dated 21-09-2017 passed by the Hon’ble State Commission of W.B. against in 1^st Appeal No. A / 2051 / 2015 arising out of order dated 30-01-2015 in C.C. no.92 of 2013 of Bankura District Forum.

According to that order the Hon’ble S.C. allowed the appeal and set a side the impugned order passed by this District Forum on 30-01-2015 in C.C. no.92 of 2013 and the case is remanded to the Ld. District Forum for hearing afresh having due regard to the provisions laid down u/s 13 (2)(b) (  ) of the C.P. Act, 1986.

In view of the above order of Hon’ble S.C. the Exe. Case no.08 of 2015 be and the same is dismissed.

Copy of this order be supplied to the parties each immediately without cost.
