Petitioner had admitted its liability to Rs. 1,08,000/- to the Respondent. Petitioner paid a sum of Rs. 50,000/- by cheque and contended that the remaining amount of Rs. 58,000/- was paid by him in cash. The fora below have rejected the plea taken by the Petitioner. We agree with the view taken by the fora below that there is no proof on record to show that the Petitioner had paid the sum of Rs. 58,000/- in cash to the Respondent. Dismissed.
