This case record is put up today in view of the put up petition filed by J/dr Moitraya Dasgupta who is the J/dr – 3 of this Execution case.  Alongwith the put up petition another application has been filed which is supported by affidavit for recalling the warrant of arrest which has been issued against J/dr – 3.

 In course of hearing the copies of order of the Hon’ble State Commission and Hon’ble National Commission have been filed.  From the order of the Hon’ble National Commission which has passed in revision petition no.354 of 2016 it appears that Hon’ble national commission has been pleased to dismiss complaint case no.35/2006.

Most respectfully seen the judgment of Hon’ble National commission.  As the Hon’ble national Commission has been pleased to dismiss the C.C. Case no.35/2006 of this District commission, this execution case has no force and so it is also dismissed.  Let the warrant of arrest which has been issued against J/dr-3 Dasgupta Valorem Clinic in respect of which proprietor is Moitraya Dasgupta S/o Late Dr. Maniklal Dasgupta of 55, Bandel Station Road, P.O-Bandel Junction, P.S-Chinsurah Dist-Hooghly be recalled. 

Let a copy of this order be sent I.C, Chinsurah Police station for information and taking necessary steps.
