Heard Counsel for the Petitioner.  Delay condoned.  Counsel for the Petitioner has submitted before us that the Complainant  had failed to establish factum of accident and  injury   and there is no open injury  and no witnesses have been produced to support the case of the Complainant.

Learned counsel for the Petitioner has drawn our attention  to the   C.T.  Scan and has submitted  that no bone  injury was seen.  However, C.T. Scan shows contusion in cerebelar hemisphere on left side and in frontal region on right side with subarachnoid haemorrhage.  The case of the Complainant is that the petitioner’s wife had fallen down from the

kitchen platform and had received head injury.  This plea of the Complainant has been accepted by the State Commission on the basis of material on record.  In our opinion, the head injury has been duly established on account of fall and the State Commission has very rightly  ordered for payment of accidental benefit to the Complainant. 

In view of this, we do not find any merit in this revision.  The revision petitions are hereby dismissed with no order as to costs.
