Heard Ms.Neha Prashant, Advocate Proxy for ALMT Legal, Advocate for the appellant and Mr.Pritam Ohol, Advocate Proxy for Mr.D.S. Pagare, Advocate for respondent No.1.  Appellant and respondent No.1 have settled their dispute outside the Commission.  Consent Terms are filed on record.  In spite of service, respondent No.2 is not present before the Commission.  It is submitted that no relief is claimed against respondent No.2 and he is not a contesting party.  That may be the reason of absence of the respondent No.2.  Mr.Vijay Narayan Dadhe, Managing Director of the appellant is present.  Consent Terms are verified from the Managing Director of the appellant and he admits that they are true and correct.  Learned Advocate Mr.Pritam Ohol submitted that due to personal difficulties, respondent No.1 failed to appear before the Commission, but respondent No.1 is well aware about Consent Terms and he has no objection.  Hence, we pass the following order :-

                             -: ORDER :-

1.                 In view of settlement between the parties, First Appeal No.565/2012 is hereby disposed off.

2.                 Parties to bear their own costs.

3.                 Copies of the order be furnished to the parties.
