The complainant , Sri Moon Saikia is present . His counsel ld advocate Abhijeet Kakati is also present . Ld advocate Mr Difenso Mam appears for opp. party no-1 & 2 and ld advocate  Abinash  Talukdar  appears for opp. party no-3 . Complainant vide petition no-903/18 prays for allowing them to withdraw this case with a leave to file the same before the Hon’ble State Commission  afresh having presently their total claim would be encashed to Rs.85,00,000/- . The complainant and his counsel is heard on the petition . Ld counsels of the opp. party no-1 , 2 & 3 are also heard . It is found that the complainant side want to encash their total claim to Rs.85,00,000/- and for such reason this complaint  becomes out of jurisdiction of this forum . Hence, the petition is allowed  and the  complaint is dismissed on withdrawal with leave to file the same before the Hon’ble State Commission.
