This is a complaint filed under section 12 of Consumer Protection Act 1986 and the matter stood over to this date for consideration.After hearing the matter thecommission passed an order as follows:
This is a complaint filed by the complainant against the opposite parties alleging deficiency in service on the part of the opposite parties. The opposite parties entered appearance and filed version denying the allegation raised by the complainant. As the complainant was continuously absent, this Commission issued a notice to the complainant to appear before this Commission. The notice issued by this Commission to the complainant was returned with endorsement ‘addressee no more’. No legal heirs of the original complainant approached this Commission to implead themselves to proceed with this complaint. In the above circumstances we find that this is a fit case to be dismissed as abated.
In the result the complaint is dismissed as abated. There will be no order as to cost.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
