CONSUMER COMPLAINT NO. 1104  OF  2019

ORDER

1.        Office report seen. Be registered. Heard. Complainant wants to withdraw the present consumer complaint and put an endorsement on the first page of the consumer complaint. At the same time, he retracted from the endorsement and stated that it be disposed of on merits.

2.        The allegations made in the consumer complaint are, on 06.12.2019 the complainant went to the opposite party and ordered two pizza, one veg parcel and one 500ml Mountain Dew on payment of bill of Rs.308.84. It is a consolidated bill. His case is, out of this, the amount charged by opposite party of Mountain Dew is Rs.57.14 and the printed rate on bottle was Rs.60/-, while the Prem Stores, a departmental store at Sector 15, Chandigarh, charged Rs.40/- for 750ml Mountain Dew and rate printed on bottle was Rs.40/-. This is the only grouse of the complainant that opposite party sold 500ml Mountain Dew @ 60/- and other vendor sold 750ml Mountain Dew @ Rs.40/-. 

3.        Nevertheless it is the case that the amount is being charged by opposite party over and above the printed price i.e. MRP. If the same item is available at cheaper price in comparison to that of the complainant, the consumer has the liberty to purchase the same. It is not a defined unfair trade practice as per definition contained in the Consumer Protection Act as the amount charged is not over and above MRP. We find no substance in the present consumer complaint and proceed to dismiss it at preliminary stage.
