Per Shri S.R. Khanzode – Hon’ble Presiding Judicial Member:

     Both parties are absent in spite of notice published on the notice board of this Commission and on the internet.  By way of abundant precaution further intimation of today’s date through Commission has been given by post to both the parties on 21.12.2011.  In the circumstances, we proceed further to consider Misc.Application No.2732/2006 filed for condonation of delay.

     There is marginal delay of 9 days as alleged in the application.  It is submitted that after receipt of the copy of the order on 27.09.2006 there were Diwali holidays between 21.10.2006 to 29.10.2006 and Advocate of the appellant was also unwell and therefore, the delay occurred.  Delay was neither intentional nor any malafide to be attributed to the Applicant/Appellant.  We find the delay is actually of 13 days and not 9 days in filing the appeal.  However, since the delay is of very short duration, we find to condone the same.  Hence, the order:

O  R  D  E  R

    (i)               Misc.Application No.2732/2006 filed for Condonation of delay is allowed.

  (ii)               Delay in filing appeal is hereby condoned.

(iii)               No order as to costs.
