By indicating towards total value of the plot including Basic Sale Price + EDC (External Development Charges) and other charges is more than Rs.1 crore, Counsel for the Opposite Parties has placed reliance upon ratio of the judgment passed by Hon'ble National Consumer Disputes Redressal Commission, New Delhi in the case of AMBRISH KUMAR SHUKLA & 21 ORS. Vs. FERROUS INFRASTRUCTURE PVT. LTD., Consumer Case No.97 of 2016, decided on 07.10.2016, to say that this Commission lacks pecuniary jurisdiction to entertain this complaint.
Faced with the situation, complainant No.1 wishes to withdraw this complaint with liberty to the complainants to avail proper remedy before the proper Consumer Fora.
Liberty granted.
In view of above, this complaint is dismissed as withdrawn.
