At the time of arguments, it transpired that the total price of the unit, in question, as per Final Statement of Account annexed with the offer of possession letter dated 06.12.2016, is in the sum of Rs.95,59,887.40 (i.e. Rs.95,01,053.20 + Rs.58,834.20). The complainant is seeking refund. By adding the component of interest @18% p.a. on the deposited amount of Rs.89,52,535/- and compensation for mental harassment etc., in view of ratio of judgments passed by Hon'ble National Consumer Disputes Redressal Commission, New Delhi in the cases of AMBRISH KUMAR SHUKLA & 21 ORS. Vs. FERROUS INFRASTRUCTURE PVT. LTD., Consumer Case No.97 of 2016, decided on 07.10.2016 & M/s OMAXE CHANDIGARH EXTENSION DEVELOPERS PRIVATE LIMITED & ORS. Vs. LALITHA SAINI, First Appeal No.1364 of 2017, decided on 21.08.2017, it exceeds the pecuniary jurisdiction of this Commission. Faced with this situation, Counsel for the complainants wishes to withdraw this complaint with liberty to file it before Hon'ble National Consumer Disputes Redressal Commission, New Delhi.

                   Liberty granted.

                   Accordingly, this complaint is dismissed as withdrawn.

                   On submitting one photocopy of complete file, Registry will return all the three files, in original, to the decree holder, excluding zimini orders, within a week from today, against proper receipt.

                   Certified copies of the order be sent to the parties free of charge.
