The complainants, namely, Vijay Gupta and his wife Geeta Gupta have filed the present complaint under Section 17 of the Consumer Protection Act, 1986 against the opposite party for not delivering the possession of the flat to them within the stipulated time.

2.      Upon notice, the opposite party had put in appearance through its counsel. However, today none has put in appearance for the opposite party.

3.      Learned counsel for the complainants states that the subject matter of the present complaint has already been settled between the parties and in this regard deed of settlement dated 26.06.2019 has been prepared. Accordingly, the complainants do not want to pursue the complaint any further.

4.      Dismissed as not pressed.
