ORDER

Sh. Shiv Kumar, Advisor (Legal) of the judgment debtors has submitted that the judgment debtors will supply receipt with regard to adjustment/deduction of an amount of Rs.15,097/-, which was shown pending for FSA, to the decree holders. Let the said receipt be supplied to the decree holders within a period of 30 days from today. He has also submitted a calculation sheet, which is take on record. Copy of the same has been supplied to the Counsel opposite.

                   Admittedly, the remaining decretal amount has already been paid to the decree holders.

                   On previous date i.e. 25.10.2019, an amount of Rs.5 Lakhs, which was lying deposited with this Commission, was ordered to be released in favour of the decree holders. The remaining amount of FDR i.e. interest accrued, was ordered to be kept separately. It was observed that the said interest component shall be refunded to the judgment debtors after disposal of this execution application.

                   Counsel for the decree holders and Sh. Shiv Kumar, Advisor (Legal) of the judgment debtors has submittd that the decree has been fully satisfied.

                   In view of above, it is ordered that the remaining amount of FDR i.e. interest component, which was kept separate, under orders of this Commission, be released in favour of the judgment debtors – Company i.e. DLF Homes Panchkula Pvt. Ltd., against receipt and proper verification.

                   Accountant of this Commission should ensure the correctness of the particulars of the cheque to be prepared in favour of the party concerned, before issuing the same, by tallying the particulars from the application.         

                   Needful be done within three weeks from today.

                   In view of above, the entire liability of the judgment debtors and the decree passed stands fully satisfied.

                   Accordingly, this execution application stands disposed of being fully satisfied.

                   Certified copies of this order be given dasti to the parties/their Counsel free of charge.
