ORDER

It is stated at the bar by Sh. Shiv Kumar, Advisor (Legal) of the judgment debtors that an amount of Rs.19,63,866/- has been paid by the judgment debtors to the decree holders towards compensation by way of interest on the amount paid and the amount granted towards mental agony and physical harassment and litigation charges have also been paid.

                Sh. Narender Yadav, Advocate, Counsel for the decree holders states the said compensation has been paid up to the date of offer of possession plus two months more. He further states that as possession was offered, we cannot go beyond the decree passed. Otherwise also, before passing of the order by Hon’ble National Consumer Disputes Redressal Commission, New Delhi, possession stood handed over. Principal of Doctrine of Merger will apply and no compensation & interest is payable as prayed. He further states that undertaking has already been placed on record to the effect that in case any adverse order is passed by the Hon’ble National Consumer Disputes Redressal Commission, New Delhi/Supreme Court of India, excess amount found having been paid shall be returned by the decree holders to the judgment debtors alongwith interest @9% p.a. (simple) forthwith. 

                This execution application stands disposed of accordingly.

                Certified copies of this order be given dasti to the parties/their Counsel free of charge.
