Manjit Singh filed a consumer case on 20 May 2019 against DLF Homes Panchkula Pvt. Ltd. in the StateCommission Consumer Court. The case no is CC/400/2018 and the judgment uploaded on 23 May 2019.
At the time of arguments, the matter has amicably been settled in terms of order passed by Hon’ble Supreme Court of India in a bunch of Civil Appeals bearing Nos.2285-2330 of 2019 titled ‘DLF Homes Panchkula (P) Ltd. Vs. Sushila Devi and anr. etc.’ and it is agreed that on the amounts deposited from the respective dates, interest shall be paid @9% p.a. (simple) till today. The complainant shall not be entitled to any amount towards facing mental any and physical harassment and also litigation expenses. The amount, after making calculation, shall be paid by the opposite parties to the complainant within three months from today.
We make it very clear that in case the amount is not so paid within the time stipulated above, it will start getting interest @10% per annum (simple) from the date of default till the time of making the payment.
We also make it clear that as the amount of interest is being paid towards compensation for the loss suffered by the complainant, therefore, no tax at source is to be deducted in terms of judgment passed by Hon’ble National Consumer Disputes Redressal Commission, New Delhi in First Appeal No.531 of 2016 titled ‘Puma Realtors Pvt. Ltd. Vs. Abha Arora’ on 11.10.2018.
In the event of not complying with the order, this order shall be treated as an executable decree and it shall be open to the complainant to file an execution application.
Accordingly, this complaint stands disposed of in the aforesaid terms.
Certified copies of this order be given dasti to the parties/their Counsel free of charge.
