ORDER

At the time of arguments, matter has amicably been settled. On telephonic instructions from Sh. Shiv Kumar, Legal Advisor (North), it is stated by Ms. Ekta Jhanji, Advocate, Counsel for the Opposite Parties that for delayed period, compensation will be paid to the complainants, in terms of Clause 15 of the Independent Floors Buyer’s Agreement dated 03.02.2011. Penalty amount will be calculated from 02.02.2013. It is also agreed that to compensate the complainants, an amount of Rs.1,50,000/- shall be paid and besides that, an amount of Rs.30,000/- will be paid towards litigation cost.

                   The proposal made is acceptable to the Counsel for the complainant.

                   It is further agreed that to calculate as to whether any additional area exists, measurement will be made in presence of both the parties and if it is found that area of the flat at the spot is more than the agreed area i.e. 1751 sq. ft. (super area), then the complainants shall make payment for the additional area at the rates, at which, initial flat was allotted. The possession will be handed over to the complainants within 15 days from today after effecting necessary repairs etc., as pointed out in document (Annexure C-15). Qua payment of statutory dues, the same shall be payable by the complainants as and when they are going to get sale deed executed or any other tax is due against them. The amounts, so agreed between the parties, shall be paid by the Opposite Parties to the complainants, within one month from today, failing which, the amount, so calculated, shall fetch interest @12% p.a. till such time, the payment is not made by the Opposite Parties. 

                   With above-said observations, the complaint stands disposed of.

                   Certified copies of the order be sent to the parties free of charge.
