Amit Kumar Gupta Son of Sh. Amrit Lal Gupta filed a consumer case on 25 Mar 2019 against DLF Homes Panchkula Pvt. Ltd. in the StateCommission Consumer Court. The case no is EA/333/2018 and the judgment uploaded on 27 Mar 2019.
On the last date of hearing i.e. 21.02.2019, following order was passed by this Commission:-
“Vakalatnama on behalf of the judgment debtors not filed. Be filed on the next date of hearing.
As per office report, an amount of Rs.62,13,422/- through demand draft has been received by the Counsel for the decree holder(s) on 21.02.2019 being the principal amount. This fact is admitted by Counsel for the decree holder(s). It is stated by Counsel for the decree holder(s) that he has given an undertaking with the Secretary of this Commission that he will abide by the decision of the Hon’ble Supreme Court of India.
It is stated by Sh.Shiv Kumar, Advisor (Legal) of the judgment debtor(s) that the matter will be listed before the Hon’ble Supreme Court of India for tomorrow.
On request, the matter is adjourned to 25.03.2019 for further proceedings.”
The judgment debtors were directed to pay the balance amount. Sh. Shiv Kumar, Advisor (Legal) of the judgment debtors has placed on record copy of order dated 22.02.2019 passed by Hon’ble Supreme Court of India passed in Special Leave to Appeal (C) No(s).4363-4366 of 2019 staying further proceedings in execution. Copy of the said order is taken on record.
In view of above, this execution application stands disposed of at this stage, However, liberty shall remain with the decree holder to file a-fresh execution application as and when final order is passed by Hon’ble Supreme Court of India or stay granted is varied/vacated.
Certified copies of this order be sent to the parties free of charge.
