Sh Rajinder Singh Thakur filed a consumer case on 23 Jan 2019 against DLF Homes Panchkula Private Ltd. in the StateCommission Consumer Court. The case no is CC/455/2018 and the judgment uploaded on 29 Jan 2019.
This complaint has been filed for issuance of directions to the opposite parties to handover possession of the flat purchased to the complainants and also to make payment of compensation on account of delayed possession, compensation for mental agony and harassment etc.
Perusal of record indicates that possession of the unit, in question, was offered to the complainants by the opposite parties on 29.10.2016 and when we ask Sh. Amarbir Dhaliwal, Advocate, Counsel for the complainants that what was the reason not to accept the same, he states that the complainants only objected to the opposite parties that the project was not complete and as such, they failed to get possession. There is nothing on record in writing.
Faced with this situation, when we told Sh. Amarbir Dhaliwal, Advocate, Counsel for the complainants that probably under the circumstances, the complainants may not get compensation for the delayed period after the date of offer of possession and the date of filing this complaint and further also, he wishes to withdraw this complaint with liberty to file it before any other competent Fora/Authority.
Liberty granted.
Accordingly, the complaint is dismissed as withdrawn.
