Kamaldeep filed a consumer case on 20 May 2019 against DLF Homes Panchkula Private Limited in the StateCommission Consumer Court. The case no is CC/384/2018 and the judgment uploaded on 23 May 2019.
Possession of the unit, in question, has already been handed over. At the time of arguments, it is agreed that qua payment of compensation by way of interest, this matter is fully covered by the ratio of the judgment in the case of DLF Homes Panchkula Pvt. Ltd. Vs. D. S. Dhanda etc. etc., Civil Appeal Nos.4910-4941 of 2018 decided by Hon’ble Supreme Court of India on 10.05.2019 and it be disposed of accordingly.
Sh. Shiv Kumar, Advisor (Legal) of Opposite Parties No.1 & 2 states that an amount of Rs.19,100/- is due for payment by the complainant.
As per settlement, this complaint is disposed of in terms of ratio of judgment in the case of DLF Homes Panchkula Pvt. Ltd. Vs. D. S. Dhanda etc. etc. (supra). Sh. Shiv Kumar, Advisor (Legal) of Opposite Parties No.1 & 2 agreed that after adjusting the above-said amount of Rs.19,100/-, the balance amount qua due compensation will be paid within three months from today.
We make it very clear that in case the amount is not so paid, it will start getting interest @8% p.a. (simple) from the date of default till the time of making the payment. It is also agreed that order passed shall be treated as an executable decree and it shall be open to the complainant to file an execution application.
Accordingly, this complaint stands disposed of in the aforesaid terms.
Certified copies of this order be given dasti to the parties/their Counsel free of charge.
