This order will dispose of Miscellaneous Application bearing No.758 of 2017 filed by the Decree Holders/applicants for withdrawal of an amount of Rs.2,72,359/-.

                   It is stated by Counsel for the Decree Holders/applicants that when appeal was filed in the Hon’ble National Consumer Disputes Redressal Commission, New Delhi under orders of the said Commission dated 12.09.2014, the Decree Holders/applicants had deposited the aforesaid amount of Rs.2,72,359/- with this Commission on 09.12.2014.

                   Upon notice issued in this Execution Application, Ms. Ekta Jhanji, and Sh. Parveen Jain, Advocates have put in appearance on behalf of the Judgment Debtors, by submitting their power of attorney, which is taken on record.  They state that they have no objection, in case, the aforesaid amount alongwith interest, which may have accrued thereon, be disbursed in favour of the Decree Holders/applicants.

                   As per report submitted by the office, the said amount is lying deposited in the Fixed Deposit.

                   In view of above, the application aforesaid and this Execution Application, stand disposed of, directing the office to release the aforesaid amount of Rs.2,72,359/- in favour of the Decree Holders/applicants, namely, ‘Sh. S. C. Jain’ & ‘Smt. Kamlesh Jain’, as prayed for in the application, alongwith interest, which may have accrued on the said amount in the Fixed Deposit Receipt, by way of two separate cheques, in equal share.      

                   Accountant of this Commission should ensure the correctness of the particulars of the cheques to be prepared in favour of the Decree Holders/applicants, before issuing the same, by tallying the particulars from the application.

                   Needful be done within seven working days.

                   Certified copy of the order be supplied to the parties free of charge.
