  1. In brief facts of the present case are that complainant  is the sole user of water connection. It is stated that in routine water bill within due date deposited and on 14.05.2012 a bill of Rs.10296/- generated upto 16.01.2012, thereafter a bill generated from 13.07.2011 including 10296 penalty also included which was already paid on 14.05.2012. It is further stated that a letter written to Chairman DJB on 03.10.2012 and also office of ZRO visited but no positive response received. Thereafter, DJB regularly supplied the wrong bills and complainant regularly visited the office and most of the time ZRO was not available in the office.

 

  1. It is stated that Mr. Panday Dealing Clerk made necessary correction but the correction can only be materialized when ZRO makes necessary correction in the computerized record with a signature. It is stated that the complainant lastly visit on 13.05.2014 when fortunately ZRO was available in the office but did not bother about the problem of the complainant and some Mr. Rajesh Ji present there told that the dealing clerk nothing can be done in this case. It is stated that for the last two years complainant not only harassed but mentally tortured by DJB staff. The complainant compelled to pay wrong bills. It is stated that DJB may be asked to provide correct computerized bills and also make all necessary corrections in the record. DJB may be directed to pay  amicable compensation for harassment and torture and expenses and penalty be also be imposed.
  2. OP served and appeared. As per record no written reply filed. As per proceedings Ld. Predecessor of the Bench vide order dated 29.07.2019 while hearing the argument directed the OP officials to visit the premises and file a status report. On behalf of OP it was stated that complainant did not deposit a single penny against water connection as per photocopy of bill dated 29.06.2019 and total sum of due of arrear of water bill is Rs.92,921/-. AR of complainant submitted that there is no water supply in the line and not a single drop of water used. AR of complainant further submitted that K No.7245460000 is installed in the shop of complainant. As per document filed by complainant the letter dated 03.10.2012 the old K NO. is mentioned 1211357785 and new K No.7245460000.
  3. As per record OP DJB filed a record/reply dated 19.04.2017. In this reply it is stated that the issue of supply of dirty and irregular water has to be examined by engineering wing of DJB and the matter of revising the water consumption bill has been sorted out and a revised bill of Rs.32,070/- dated 18.04.2017 has been revised out of which Rs.23,769.94/- is to be paid for availing the rebate under existing scheme of DJB and bill is on the basis of minimum consumption and the revenue department resolved the issue.
  4. As per record evidence by way of affidavit filed by complainant wherein the contents of the complaint reiterated. OP filed evidence by way of affidavit of Sh. Satpal Dhingra ZRO DJB. In the affidavit it is stated that complainant from 13.07.2011 to 09.11.2015 a bill of Rs.32,070/- required to be deposited after revision but complainant failed. The bill from 09.11.2015 to 18.02.2017 was again reside in which LPSC of Rs.8300/- deducted but complainant failed to deposit the same. It is stated that till 25.02.2018 complainant failed to deposit any bill and last bill is of Rs.48,187/- and all the photocopies of bills filed on record.
  5. As per direction of the commission revenue department filed the reports of the dues against complainant and engineering department filed report regarding water supply. As per report dated 20.09.2023 the K No.7245460000 exists at the premises no. F-24/1 Sector 3 Rohini Delhi 85 in favor of Sudesh Jain complainant category II. The water supply position checked and adequate water pressure was found in the water line and quality of water was also found satisfactory. The water supply in the adjoining houses of complainant was adequate and clear. There may be fault in individual water connection and complainant was advised to check his individual water connection at his own. It is further stated in the report that a bill of Rs.132489.27/- was generated on 23.12.2012 by DJB when the waiving of LPSC scheme was launched by DJB. During the scheme the complainant had deposited Rs.34,213/- and availed the benefit of the scheme and the amount after payment was zero. It is further stated that the bill for the period 23.12.2022 to 05.07.2023 having 106 units for 214 days has been generated amounting to Rs.5957/- with due date 11.08.2023 but consumer has not deposited. It is stated that now the outstanding due against complainant is Rs.6255/- and photocopy of bill filed on record.
  6. We have heard AR husband of complainant and Ms. Lalita Gupta counsel for OP alongwith Sh. Sheshnag Rai AE for DJB and perused the record.
  7. In the present case the complainant raised firstly issue of  non payment of bill due to unjustified illegal payment by DJB since 2012. During the course of proceedings the DJB firstly revised the bill in the year 2017 but complainant failed to pay single penny. Thereafter again under the scheme the complainant deposited Rs.34,219/- against the payment of Rs.1,32,489.27/- on 27.12.2022 and taken the benefit of this scheme, water LPSC has been waived off. But later on again from 23.12.2022 complainant failed to pay the water bill of consumption of water showing 106 units. The complainant cannot take advantage of her own wrong. She has been consuming the water and not paying the bills regularly and after about 10 years under the LPSC waiver scheme complainant made the payment of all the dues but again defaulted. As per direction of commission the engineering department filed the report, the water supply found to be of adequate pressure and quality of water was also found satisfactory. The complainant is the single resident of the area who raised this issue. It is pointed out in the report of DJB that no such problem observed in the neighborhood of the complainant. It is well known fact that in the capital city Delhi there is scarcity of water, drinking water supply for limited period drinking water supply is made available by DJB to the citizen of Delhi. The photocopy of bill of complainant for period 23.12.2022 to 25.07.2023 established that complainant has been consuming the water but not paying the bills raised by DJB.
  8. In these circumstances we find complainant is regular defaulter in payment of regular consumed water bills. We do not find any deficiency of service on the part of DJB.
  9. On the basis of above observation and discussion present complaint is dismissed. No order as to cost. File be consigned to record room.
  10. Copy of the order be given to the parties free of cost as per order dated 04.04.2022 of Hon’ble State Commission after receiving an application from the parties in the registry. The orders be uploaded on www.confonet.nic.in.
