1. Pleadings of the complainant in brief
The complainant purchased a pair of spectacles on 23.07.2022 from the opposite party paying Rs.2,600/-. As the glass was giving blurred vision the complainant returned the same. The opposite party agreed to replace it and gave a glass worth Rs.200/- for temporary use, till the replacement is ready. The opposite party is yet to give the replacement and hence, this complaint is filed seeking refund of Rs.2,600/- being the cost of the glasses and a compensation of Rs.2,900/- towards expenses.
2. Notice was issued to the opposite party. They neither entered appearance nor filed version. Hence, their name was called in the open court and were set ex-parte.
3. The complainant has been continuously absent for the proceedings. Hence, the case was taken for order based on merits.
4. In the absence of proof affidavit or documentary evidence, this Commission is unable to examine the merits of this case.
5. As the complainant failed to prove a prima facie case against the opposite parties, the complaint is dismissed.
