Learned counsel for both the parties have appeared.
A compromise (paper No. 91 of the appeal file) between the parties has already been filed on record, which was accepted by both the counsel for the parties to the appeal and the terms and conditions of the compromise were accepted by the concerned counsel.
A perusal of the record has revealed that a draft of Rs. 22,000/- (Rupees Twenty Two Thousands only) in terms of compromise has already been deposited, which was kept on record in safe custody.
As both the counsel has appeared and the compromise has already been accepted by them, therefore, we are of the view that the compromise should be accepted. Therefore, the compromise is hereby accepted.
The appeal is decided accordingly in terms of compromise.
The compromise (paper No. 91 of the appeal file) shall form part of the decree. No order as to costs of the appeal.
Statutory amount, if any, deposited by the appellant be returned to the appellant.
File be consigned to the record room alongwith copy of this order.
A copy of this order alongwith copy of compromise clubbed with original record of the District Commission be sent to the concerned District Commission for perusal and necessary information.
